General Terms and Conditions (GTC) of Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN), the legal operator of the Payflink ordering system.

1. General

All deliveries and services of Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) and the associated online orders as well as other online services are subject to these General Terms and Conditions (GTC). Deviating and/or supplementary agreements require the express consent of the management of Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) as well as the written form; this also applies to a waiver of the written form requirement.

2. payflink order system

The Payflink ordering system allows you to place orders and make payments at Hospitality Visions Lake Lucerne AG of Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN). You hereby authorize Payflink to forward your orders, personnel data and corresponding identification information to the Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN).

3. Use of the ordering system

You certify that you are a person with legal capacity who is capable of entering into a binding contract.

In particular, you confirm the following:

You will use the Order System only as described in these Terms and Conditions.

You will not permit any third party to use your account or use any third party's account

You will comply with all laws when using the Ordering System.

You do not interfere with the proper operation of the network

You will not attempt to damage the ordering system

You will provide us with such proof of identity as we deem appropriate

You will not use the Ordering System with an incompatible or unauthorized device

In addition, Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) and Payflink reserves the right to terminate the Service and use of the Ordering System if you fail to comply with all of the above obligations.

Accessing and/or using the Ordering System may incur data and connection charges from your wireless service provider or other fees.

Payflink does not guarantee that the ordering system will work on every hardware or device. In addition, the service or software may experience problems and delays caused by the use of the Internet and electronic communications.

In particular, Payflink cannot be held liable if you do not have a compatible mobile device or if you are using the wrong version of the software.

4. Order

You are responsible for your placed order. Orders placed by you are binding as soon as they are confirmed by Payflink respectively Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN). No refund or correction of the order can be made through the software. It is solely up to the Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) to decide whether to accept changes to a placed order.

5. Delivery

Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) will, as far as possible, agreed or specified delivery times on time. Further claims of the buyer - especially on delivery - as well as on the risks and side effects possibly caused by the product, are excluded

6. Payment

You agree to pay in full for all products you order from Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) and authorize Payflink to charge you for the products or services you order through the payment method you provide (including any taxes). You are responsible for timely and full payment of all charges and for providing a valid payment method (e.g., credit card) by which you will pay all charges incurred for Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN)'s products. If the payment method is not accepted by the payment processor, Payflink and the Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) will not be obligated to accept the order.

7. Right of withdrawal

For orders paid and made online, there is no right of withdrawal.

8. Deficiencies

Claims due to scope of delivery, material defects, wrong deliveries and quantity discrepancies are to be asserted as far as they can be determined by reasonable examinations. In the case of justified complaints, Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) will correct the incorrect delivery free of charge and otherwise, subject to exclusion, will at its option exchange the products, take them back or grant the Buyer a price reduction.

9. Customer data

The Hospitality Visions Lake Lucerne AG (nachfolgend: Neuro Campus Hotel DAS MORGEN) is entitled to collect, store and process the personal data of the customer required within the scope of the business relationship, this in consideration of the corresponding duty of care in dealing with sensitive customer data.

10. Final provisions

The invalidity of individual points of these General Terms and Conditions of Business (GTC) shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a new provision that comes as close as possible in its economic effect to the invalid provision. Place of performance and jurisdiction for contracts, including these General Terms and Conditions (GTC), is Lucerne, Switzerland.
